When the case was heard by the City magistrates, Cooling offered a defence. He had been cleaning out his pipe with his penknife, he said. Hall had remarked that it seemed ‘very sharp’ and Cooling held it out towards him saying, ‘Have I to try it?’ Hall said, ‘Yes’. It was then, Cooling claimed, that he said, ‘Am I to do it now?’ Hall bared his neck but, as Cooling advanced the blade towards his friend, Hall twisted round and thus made contact with the knife.

The magistrates were having none of it. Florence Hall and Alice had been entirely clear about what they had seen and heard. Cooling was committed for trial at Leeds Assizes on the charge of murder. The case came to court on 11 May. Cooling said that the death was one of the biggest accidents that could have occurred. He would rather have killed himself than injured any member of Hall’s family. His defending counsel pointed out that there was no motive for a wilful killing. In summing up, the judge made much of the fact that the evening had been a perfectly pleasant and happy one. No evidence had been given by anyone to show why Cooling should have got into a white passion.

Cooling was found not guilty and discharged. Perhaps the conversation about the knife which, allegedly, took place between Cooling and Hall, happened whilst Alice and Florence were seeing Thornton to the door. But what it if never took place at all?
